Terms and Conditions

This agreement applies as between you, the User of this Website and Active Education, the owner(s) of this Website. Your agreement to comply with and be bound by Clauses 1, 2, 4 – 11 and 15 – 25 of these Terms and Conditions is deemed to occur upon your first use of the Website. Clauses 3 and 12 – 14 apply only to the sale of Services. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.

1. Registration & Payment

To enroll in any course offered by Active Education, the applicant is required to pay the applicable tuition fee. Tuition fees for each program are listed and kept current on our official website. Fees are billed on a monthly basis.  Tuition fees are charged on a subscription basis and may be adjusted over time. The tuition fee applicable at the time of each monthly payment is the one listed on our website on the day the payment is processed. Active Education reserves the right to adjust tuition fees at any time. Students will be notified in writing if a monthly fee increases by more than 15% compared to the fee at the time of their initial enrollment.

2. Booking Conditions and Scope

Upon completing the registration process through our website, a study place is automatically reserved, provided that the selected program has available capacity. Programs that are fully booked cannot be registered for. The booking becomes binding once Active Education has received the completed online registration form and the required administration fee has been paid. The scope of the booking is limited to the services explicitly agreed upon between the student and Active Education. Only services explicitly confirmed in writing by Active Education form part of the agreement. Any information not provided in writing is non-binding.. All written communication between Active Education and the student shall serve as the basis for interpreting the scope of the agreement. 

3. Duration of Study and Access to E-Learning

Students are granted access to the course and its associated e-learning platform for a period of up to 12 months from the date of enrollment. The final examination must be scheduled within this 12-month period. Should the student require extended access beyond the initial 12 months, this may be granted at our discretion and subject to current extension fees. 

4. Website and Social Media Information

Active Education strives to ensure that all information provided on our website and social media channels is accurate and up to date. Information published on external channels is for guidance only and does not constitute a binding part of the agreement. 
It is the student’s responsibility to verify any information that may appear unclear or uncertain. Active Education is not liable for decisions made based on outdated or incorrect information found on these platforms. 

5. Language of Instruction

Our primary language of instruction is English on courses sold on www.activeeducation.global. We currently do not offer teaching or exams in other languages. 

6. Use and Distribution of Educational Material

As a student, you have access to educational materials during your active study period. PDF documents may be downloaded for personal use. Videos are streamed through the student platform and may not be downloaded or recorded.  All materials are copyright protected and must not be shared or published. Violation of copyright terms may result in immediate removal of access without refund. 

7. Tuition fee

Includes all instruction and activities as described in the syllabus for your location and semester. Not included: travel costs, accommodation, meals, books, passport, visas, insurance, or optional activities.

9. Active Education's Obligations

We will make reasonable efforts to deliver the program as described. Minor adjustments may occur and are not considered deviations

10. Student's Responsibilities

  • Stay informed via http://www.activeeducation.global
  • Ensure payments are made on time 
  • Follow rules at the study site 
  • Meet admission deadlines and requirements 
  • Fulfill coursework
  • Respect code of conduct 

Misbehavior or failure to comply may lead to loss of access without refund. 

11. Withdrawal

Withdrawal is only possible prior to the first login to the learning platform. Once access has been granted, no refunds are possible regardless of usage. Confirmation of withdrawal will be sent to you.

12. Interruption

No refunds are given after the study has started, regardless of reason. Students are advised to purchase insurance covering such cases. 

13. Changes in Price, Services, Study Plan

We reserve the right to: 

  • Adjust prices (students notified if above 15%) 
  • Adapt services due to external circumstances (e.g. force majeure) 
  • Modify schedules/modules to improve delivery 


Adjustments do not entitle students to refunds unless otherwise stated in these terms. 

14. Right to Cancel Program

We may cancel if:
 
  • Too few students register
  • Key instructors are unavailable
  • Force majeure situations occur (e.g. war, pandemic, etc.)

 
Full refund applies if canceled before start. In the event of cancellation, Active Education’s liability is strictly limited to a refund of tuition fees paid.

15. Student’s Right to Cancel

Students may cancel with full refund if:

  •  Force majeure occurs near study site
  •  Tuition increases by more than 15%

16. Deficiencies, Complaints, Compensation

  • Minor deviations are not considered deficiencies 
  • Written notice must be given promptly 
  • We may correct deficiencies 
  • Liability applies only to losses caused by Active Education 
  • We are not liable for indirect losses or student negligence Force majeure absolves us of liability 


Active Education’s total liability is limited to the amount of tuition fees paid by the student. We are not responsible for consequential, indirect, or financial losses of any kind. 

17. Injury During Compulsory Activities

Students participate in all activities at their own risk unless injury is directly and demonstrably caused by negligent actions by Active Education

18. Active Education’s Right to Terminate

We may terminate your participation in case of: 

  • Non-payment 
  • Misconduct, harassment, drug use 
  • Failure to meet program admission requirements 


Termination due to student misconduct does not entitle the student to any refund. 

19. Website availability

  • The Website is provided “as is” and on an “as available” basis. Active Education uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
  • We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

20. Photos and Video 

Images will be used in accordance with GDPR and for general marketing purposes only. Students may opt out at any time by written request. 

21. Exam Retake

One attempt per examination is included in the tuition fee. You may retake failed or missed exams for a fee of 50 $ per attempt. Exams can be retaken earliest 3 weeks after a failed attempt. Max 3 attempts per exam. Must be completed within 3 years of program end. Retake fees are non-refundable. 

22. Program Duration

Program lengths are approximate. Start/end dates may vary slightly due to calendar structure.

We reserve the right for typographical errors. These terms are subject to change. The version in effect at the time of enrollment applies.
